Corrib Gas Field: Further Questions For Mr. Dempsey

In the context of the jailing of 5 men from Mayo for contempt of court the following is a follow up letter to my letter of 3rd July 2005, sent to Mr. Noel Dempsey, Minister for Communications Marine and Natural Resources.

Re:       Bord Gais Eireann and the Corrib Gas pipeline

Dear Minister,

Further to our letter of 3rd July 2003, we call upon you pursuant to Council Directive 2003/4/EC to make prompt disclosure to us of the following documents and papers:

1. A copy of an Agreement, note, memorandum (if any) recording terms between Enterprise Energy Ireland Ltd.. Statoil Exploration (Ireland) Ltd. and Marathon International Petroleum (Hibernia) Ltd. or their successors for the transfer, assignment or sharing of ownership or control of the onshore upstream pipeline leading from the landfall at Dooncarton County Mayo to the terminal at Bellanaboy Bridge County Mayo to/with Bord Gais Eireann.

This document is required to ascertain the provisions thereof relating to covenants (enforceable and otherwise) by Enterprise Energy Ireland Ltd.. Statoil Exploration (Ireland) Ltd. and Marathon International Petroleum (Hibernia) Ltd. or their successors for the protection of the environment.

2. A copy of every consent granted by the Minister/Department of Communications the Marine and Natural Resources to Enterprise Energy (or their predecessors howsoever titled) since 1 st January 1999 to persons or entities other than Bord Gais Eireann for Compulsory Acquisition Order/s over lands in Ireland pursuant to Section 32 of the Gas Act 1976 (as amended).

These documents are required to ascertain the provisions thereof relating to covenants (enforceable and otherwise) by grantees or their successors for the protection of the environment.

3. A copy of every application made to the Minister/Department of Communications the Marine and Natural Resources to Enterprise Energy (or their predecessors howsoever titled) since 1 st January 1999 by persons or entities other than Bord Gais Eireann for Compulsory Acquisition Order/s over lands in Ireland pursuant to Section 32 of the Gas Act 1976 (as amended).

These documents are required to ascertain the provisions thereof relating to the evidence adduced (if any) as to the constituent parts of the gaseous and other media reasonably contemplated, expected, assumed or calculated to be carried in the said pipeline/s and dealing with the effects (potential and actual) on the environment and the measures (if any) to protect the environment from same.

Please also note that any such disclosure is required to be made in full and open manner as is legislated for in Council Directive 2003/4/EC and within the time limits set out in the Directive.
